Purpose & Scope: This tool generates a template document for physician review. NULU is not a medical, legal, or tax advisor. Final determination of medical necessity and reimbursement eligibility rests solely with your physician, the Department of Veterans Affairs, or your plan administrator.
"As-Is" Warranty Disclaimer: This software tool is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and suitability for any particular use. We do not warrant that the software will be uninterrupted, error-free, or that results will be complete or reliable. Use of the software is at the user's own risk.
Conservative Alternatives & Functional Non-Equivalence: Users and prescribing physicians are solely responsible for documenting either: (1) that lower-cost conservative alternatives (e.g., adaptive utensils, built-up handles, or rocker knives) have been trialed and failed; or (2) that such alternatives are not clinically equivalent to the NULU device due to specific biomechanical, safety, or functional requirements (such as force-transfer geometry or point-free safety) required for the patient's condition.
FSA/HSA & VA Reimbursement: Generation of a Letter of Medical Necessity (LMN) does not guarantee that an expense will be deemed a "qualified medical expense" under IRC §213(d). FSAs typically reimburse costs incurred during the coverage period for the alleviation of a physical defect or illness. Per IRS and VA guidance, receiving medical services from the VA for a service-connected disability does not disqualify a veteran from contributing to a Health Savings Account (HSA). However, using VA services for non-service-connected care may affect HSA contribution eligibility for a three-month period. Users are prohibited from seeking multiple tax-favored reimbursements for the same expense (e.g., claiming the same NULU purchase from both an FSA and a VA grant).
HIPAA & PHI Data Handling: This tool is designed for session-only use. NULU does not store, transmit, or retain Protected Health Information (PHI) beyond the active session or PDF generation. Users and healthcare providers remain solely responsible for the secure handling and transmission of generated documentation in compliance with HIPAA and state privacy laws.
Safety Red Flags — Seek Clinical Supervision: This tool does not perform clinical safety screening. Users with the following conditions should consult a physician or occupational therapist before use: grip strength below 5 lbs or severe tremors combined with low vision; diagnosed cognitive impairment, dementia, or altered mental status; or recent post-operative status or unstable medical condition.
Governing Law: This disclaimer shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.
